No you can’t. You can claim it under code head height, but only down to 5 ft. As long as 2/3rd of the other space is over code height 7ft., 7.5ft.
I’m pretty sure Barbara Callan sold a similar unit in the same building for more a few years ago. I think the real issue here is that whoever remodeled the unit put prime living space in the converted attic space, which is very risky. I think if they’d kept a traditional floor plan, it wouldn’t be so quirky and might sell faster.
